The technical e-commerce infrastructure for our online store is provided by Shopify.

These Terms of Service govern your access to and use of the Services, including purchases made through our online store.

Our Privacy Policy, Return and Refund Policy, Shipping Policy, Payment Policy and any other policies displayed through the Services may also form part of the agreement between you and us.

Please read these Terms carefully before using the Services.

By visiting the website, creating an account, placing an order or otherwise using the Services, you agree to comply with these Terms.

If you do not agree to these Terms, you should not use the Services.

Nothing in these Terms is intended to exclude, restrict or reduce any mandatory consumer right that cannot lawfully be waived.

3. Eligibility and Use of the Services

You may use the Services only if you are legally capable of entering into a binding agreement under the laws applicable to you.

By using the Services, you confirm that you have reached the applicable legal age required to enter into a purchase contract.

Where permitted by law, a minor may use the Services only with the involvement and supervision of a parent or legal guardian.

You agree to use the Services only for lawful purposes and in accordance with these Terms.

We may refuse, limit, suspend or terminate access to the Services where we reasonably believe that a user:

  • Has materially violated these Terms;

  • Has provided false or misleading information;

  • Is using the Services for unlawful or fraudulent purposes;

  • Has attempted to interfere with website security; or

  • Creates a material risk to us, other customers or third parties.

4. Customer Accounts

Certain features may require you to create a customer account.

When creating an account or placing an order, you may be required to provide information such as:

  • Your name;

  • Email address;

  • Telephone number;

  • Billing address;

  • Delivery address;

  • Payment information; and

  • Other information reasonably necessary to process your order.

You agree that information supplied by you will be accurate, current and complete.

You are responsible for keeping your account login information confidential.

You should contact us promptly if you believe your account has been accessed or used without authorization.

You may not sell, transfer, assign or otherwise provide your customer account to another person without authorization.

5. Product Information

We take reasonable steps to ensure that product descriptions, specifications, prices and images displayed through the Services are accurate.

However, the appearance of a physical product may differ slightly from images displayed online because of factors such as:

  • Screen settings;

  • Device type;

  • Lighting;

  • Photography;

  • Manufacturing variations; or

  • Product improvements.

Product images are provided for reference and illustrative purposes.

We cannot guarantee that colors displayed on your screen will exactly match the physical product.

We may update product descriptions, specifications or images when reasonably necessary to correct information or reflect product changes.

We may also:

  • Modify or discontinue products;

  • Limit available quantities;

  • Restrict sales to certain locations;

  • Introduce new models or versions; and

  • Correct product information.

Nothing in this section affects mandatory rights available to you where a product is defective, incorrectly described or otherwise does not conform to the purchase contract.

6. Product Availability

All products are offered subject to availability.

Adding an item to your shopping cart does not reserve the product or guarantee that it will remain available.

A product may become unavailable between the time it is added to the cart and the time your order is processed.

If an ordered product becomes unavailable, we may:

  • Cancel the affected item;

  • Offer a suitable alternative;

  • Contact you for further instructions; or

  • Refund the amount paid for the unavailable item.

Where an alternative product is offered, you are not required to accept it unless otherwise agreed.

7. Placing an Order

Submitting an order through our online store constitutes an offer to purchase the products selected by you.

An automated order acknowledgment confirms that we have received your order. It does not necessarily mean that your order has been accepted.

A binding purchase agreement will normally be formed when we:

  • Send an order acceptance confirmation;

  • Confirm that the order has been dispatched; or

  • Otherwise expressly confirm acceptance of the order.

Please review all order information carefully before completing your purchase.

Once an order has entered processing or fulfilment, we may not be able to make changes or accept a voluntary cancellation request.

This does not affect any statutory cancellation or withdrawal right available to you.

8. Our Right to Reject or Cancel an Order

We may reject or cancel an order where reasonably necessary, including where:

  • A product is unavailable;

  • Payment authorization fails;

  • Payment cannot be verified;

  • Incorrect billing or delivery information has been provided;

  • Fraudulent or unauthorized activity is suspected;

  • An obvious pricing or product error has occurred;

  • An applicable purchase limit has been exceeded;

  • Delivery to the supplied location is unavailable; or

  • Processing the order would violate applicable law.

If payment has already been collected for an order that we cancel, the appropriate amount will be refunded using the original payment method unless another method is agreed or required.

We may contact you using the contact information supplied with your order when clarification or verification is necessary.

9. Personal and Household Purchases

Unless otherwise agreed in writing, products purchased through the Services are intended primarily for personal or household use.

You must not use the Services for:

  • Unauthorized commercial resale;

  • Fraudulent transactions;

  • Unlawful export;

  • Sanctions evasion;

  • Misrepresentation; or

  • Any other unlawful purpose.

We may reasonably restrict quantities or cancel orders where we have reasonable grounds to believe that products are being purchased for unauthorized resale, fraud or unlawful use.

10. Prices and Promotions

The price payable for a product will normally be the price displayed when the order is submitted.

Prices, promotional offers and discounts may change from time to time.

A subsequent price change will not normally affect an order that has already been accepted.

If a displayed price is clearly incorrect because of an obvious technical, typographical or administrative error, we may contact you before fulfilling the order.

Promotions may be subject to additional conditions concerning:

  • Eligibility;

  • Promotional periods;

  • Participating products;

  • Minimum purchase requirements;

  • Discount limits; and

  • Number of permitted uses.

Where specific promotional conditions apply, those conditions will govern the relevant promotion.

11. Taxes, Customs and Additional Charges

Depending on the destination and the information displayed during checkout, the amount payable may include or exclude charges such as:

  • Applicable taxes;

  • VAT;

  • Customs duties;

  • Import charges;

  • Delivery fees; or

  • Other charges imposed by relevant authorities.

Where reasonably possible, applicable charges collected directly by us will be displayed during checkout.

For international orders, additional charges may be imposed independently by customs or other authorities in the destination country.

Unless we expressly state that such charges are included in the order price, the customer may be responsible for charges imposed directly by the relevant authorities.

12. Payment

You agree to provide accurate and complete billing and payment information.

By using a payment method through the Services, you confirm that:

  • You are authorized to use the selected payment method;

  • Information supplied by you is correct; and

  • You authorize the applicable payment provider to process the transaction.

Payments may be processed by Shopify or independent payment service providers.

Available payment methods will be displayed during checkout and may vary depending on factors such as:

  • Country or region;

  • Currency;

  • Product;

  • Order amount; and

  • Payment provider availability.

We may delay or cancel an order where a payment cannot reasonably be verified or authorized.

Additional information concerning payments may be provided in our Payment Policy.

13. Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy.

Delivery times displayed through the Services are estimates unless expressly stated to be guaranteed.

Delivery may occasionally be affected by circumstances including:

  • Carrier delays;

  • Customs inspections;

  • Incorrect delivery information;

  • Severe weather;

  • Public holidays;

  • Transportation disruption;

  • Regulatory restrictions;

  • Strikes;

  • Natural disasters; or

  • Other circumstances outside our reasonable control.

You are responsible for providing an accurate and complete delivery address.

Where delivery fails because the address supplied by you is materially incorrect or incomplete, you may be responsible for reasonable redelivery costs where permitted by law.

For consumer purchases, the risk of accidental loss or damage will generally pass to you when you, or a third party designated by you other than the carrier, receives the goods, subject to applicable consumer law.

14. Returns and Right of Withdrawal

Returns, exchanges and refunds are governed by our Return and Refund Policy.

Consumers who purchase eligible goods online may have a statutory right to withdraw from a distance purchase within 14 days under applicable European consumer protection law.

Where the statutory right of withdrawal applies:

  • You may withdraw without providing a reason;

  • You must notify us before the withdrawal period expires;

  • Goods must be returned within the applicable statutory period; and

  • You may be responsible for the direct cost of returning the goods where this responsibility has been properly disclosed.

If a product is defective, damaged, incorrectly supplied or otherwise non-conforming, return shipping and available remedies will be handled in accordance with applicable law and our Return and Refund Policy.

We also offer a voluntary 30-day return policy for eligible products.

The voluntary 30-day policy provides additional return options and does not replace or reduce statutory consumer rights.

15. Refunds

Approved refunds will normally be returned using the original payment method unless another method is agreed or required by law.

Refund processing times may depend on:

  • The type of return;

  • Payment method;

  • Date on which returned goods are received;

  • Date on which acceptable proof of return is provided; and

  • Processing times of the relevant bank or payment provider.

Where a statutory withdrawal right applies, refunds will be handled within the applicable statutory period.

Where permitted by law, we may withhold reimbursement until we have received the returned goods or until you provide acceptable evidence that they have been sent back.

Please refer to our Return and Refund Policy for additional information.

16. Intellectual Property

Content made available through the Services may be protected by copyright, trademark and other intellectual property laws.

Such content may include:

  • Business names;

  • Logos;

  • Product names;

  • Product descriptions;

  • Photographs;

  • Graphics;

  • Videos;

  • Audio;

  • Text;

  • Designs;

  • Website layouts;

  • Software; and

  • Icons.

Content may belong to us, Shopify, our licensors, service providers or other rights holders.

Unless otherwise permitted by law, you may use the Services and their content only for personal and non-commercial purposes.

Without appropriate authorization, you must not:

  • Copy or reproduce protected content;

  • Modify or adapt protected content;

  • Republish or distribute it;

  • Create unauthorized derivative works;

  • Sell or commercially exploit protected content;

  • Remove copyright or intellectual property notices;

  • Use protected content to mislead others; or

  • Use protected trademarks or business identifiers without authorization.

Nothing in these Terms transfers intellectual property ownership to you.

17. Customer Reviews and Submitted Content

Where the Services allow you to submit reviews, comments, photographs, videos, suggestions or other content, you retain ownership of your original content.

By submitting such content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, translate, publish and display the content for legitimate purposes connected with the Services, including:

  • Operating the Services;

  • Displaying customer reviews;

  • Promoting products;

  • Improving the online store;

  • Responding to customer feedback; and

  • Marketing the Services.

You confirm that content submitted by you:

  • Is accurate to the best of your knowledge;

  • Is owned by you or submitted with appropriate permission;

  • Does not violate another person's rights;

  • Is not unlawful or intentionally misleading;

  • Is not abusive, defamatory or obscene;

  • Does not contain malicious software; and

  • Properly discloses compensation or incentives where required by law.

We may remove or refuse content that violates these Terms, applicable law or another person's rights.

18. Third-Party Tools and Services

The Services may include features, integrations or tools provided by third parties.

We may not own or control those third-party services.

Your use of a third-party service may be subject to that provider's own terms, privacy policy and other conditions.

You should review the relevant terms before using an independent third-party service.

To the extent permitted by law, we are not responsible for a loss caused exclusively by an independent third-party service outside our reasonable control.

19. Third-Party Links

Our website may contain links to independent third-party websites, applications or platforms.

We do not necessarily own or control those services.

We do not guarantee the accuracy, security, availability or quality of independent third-party content.

When you leave our website, the third party's own terms and privacy practices may apply.

A transaction completed directly with an independent third party is generally between you and that third party.

20. Relationship With Shopify

Our online store is hosted and supported by Shopify.

Shopify may provide technical services including:

  • Store hosting;

  • Checkout technology;

  • Payment integrations;

  • Security tools;

  • Store administration functions; and

  • Data processing services.

Unless expressly stated otherwise, products offered through our online store are sold by Uddannelse i Meditativ Healingmassage, not Shopify.

Shopify is not normally the seller of products listed through our store and is not a party to the purchase agreement between you and Uddannelse i Meditativ Healingmassage.

Shopify may independently process certain personal information in accordance with its own privacy documentation and applicable law.

21. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Our Privacy Policy explains matters including:

  • What personal information may be collected;

  • Why it may be processed;

  • How it may be disclosed;

  • How long it may be retained;

  • International data transfers; and

  • Data protection rights that may be available to you.

Because Shopify and other service providers support the online store, they may also process information necessary to provide their respective services.

22. Errors and Corrections

Information displayed through the Services may occasionally contain:

  • Typographical errors;

  • Incorrect prices;

  • Outdated product information;

  • Incorrect delivery estimates;

  • Availability errors; or

  • Other inaccuracies.

We may correct inaccurate information and update the Services when an error is identified.

If an obvious error materially affects an order, we may contact you and offer to:

  • Proceed using corrected information;

  • Provide an appropriate alternative; or

  • Cancel the affected order and issue an appropriate refund.

Nothing in this section limits mandatory consumer rights.

23. Prohibited Conduct

You must not use the Services:

  • For unlawful, fraudulent or malicious purposes;

  • To violate applicable laws or regulations;

  • To infringe intellectual property or privacy rights;

  • To harass, threaten, abuse or defame another person;

  • To knowingly provide false or misleading information;

  • To impersonate another person or business;

  • To distribute spam or unauthorized advertising;

  • To transmit viruses or malicious software;

  • To gain unauthorized access to accounts or systems;

  • To interfere with website security or performance;

  • To unlawfully collect personal information;

  • To unlawfully scrape protected website content;

  • To bypass security or access controls; or

  • To commercially exploit the Services without authorization.

We may investigate suspected misuse and restrict or terminate access where reasonably necessary.

Unlawful conduct may be reported to relevant authorities where appropriate.

24. Automated Tools and Agents

Automated software, robots, artificial intelligence tools or other automated agents must not access or interact with the Services in a way that:

  • Circumvents security controls;

  • Bypasses CAPTCHA systems;

  • Ignores technical access restrictions;

  • Conceals automated activity for abusive purposes;

  • Scrapes protected data without authorization;

  • Accesses customer accounts without authorization;

  • Materially interferes with website performance; or

  • Otherwise violates these Terms or applicable law.

We may use reasonable technical measures to restrict automated access that creates security, privacy, operational or intellectual property risks.

25. Suspension and Termination

We may suspend or terminate access to some or all of the Services where reasonably necessary because:

  • These Terms have been materially breached;

  • Fraud or unlawful activity is reasonably suspected;

  • A payment remains lawfully unpaid;

  • Website or account security has been threatened;

  • An account poses a material risk to customers or third parties; or

  • We are legally required to do so.

Where reasonably possible and legally appropriate, notice may be provided before suspension or termination.

Termination does not affect rights or obligations that arose before termination.

Terms concerning intellectual property, privacy, liability, disputes and other provisions intended to survive termination will continue to apply where appropriate.

26. Availability and Warranties

We make reasonable efforts to keep the Services available, accurate and secure.

However, we cannot guarantee that the website will always be:

  • Uninterrupted;

  • Free from technical faults;

  • Compatible with every browser or device;

  • Completely secure; or

  • Free from temporary errors.

Except where expressly stated or required by applicable law, website functionality is provided on an “as available” basis.

Nothing in these Terms excludes or restricts:

  • Mandatory product guarantees;

  • Statutory conformity rights;

  • Remedies relating to defective products;

  • Rights concerning misleading descriptions; or

  • Other consumer rights that cannot legally be waived.

27. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special or consequential losses that were not reasonably foreseeable when the relevant contract was formed.

Such losses may include, where legally applicable:

  • Loss of profit;

  • Loss of revenue;

  • Loss of business opportunity;

  • Loss of data; or

  • Certain indirect expenses.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

This includes liability concerning:

  • Fraud;

  • Fraudulent misrepresentation;

  • Intentional misconduct;

  • Death or personal injury caused by negligence where liability cannot legally be excluded;

  • Mandatory product liability;

  • Non-waivable consumer rights; or

  • Any other liability that cannot legally be excluded or restricted.

28. Your Responsibility for Breaches

To the extent permitted by law, you may be responsible for reasonable losses or claims caused by:

  • Your unlawful use of the Services;

  • A material breach of these Terms;

  • Your infringement of another person's rights; or

  • Content submitted by you without the necessary rights or permission.

You will not be responsible for losses caused by our own breach, negligence or unlawful conduct.

29. Events Outside Our Reasonable Control

We will not be responsible for a failure or delay caused solely by circumstances outside our reasonable control, except where applicable law provides otherwise.

Such circumstances may include:

  • Natural disasters;

  • Extreme weather;

  • War;

  • Civil unrest;

  • Government action;

  • Epidemics or public health emergencies;

  • Strikes;

  • Transportation disruption;

  • Telecommunications failures;

  • Power outages;

  • Customs restrictions; or

  • Failures of essential third-party infrastructure.

Where such an event affects an order, we will take reasonable steps to reduce its impact and communicate with affected customers where appropriate.

Mandatory consumer rights remain unaffected.

30. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply to the fullest extent legally permitted.

Any invalid or unenforceable portion may be separated from the remaining Terms.

The remaining provisions will continue in effect.

31. No Waiver

If we delay or fail to enforce a right under these Terms, this does not automatically mean that we have waived that right.

A waiver will apply only to the specific matter to which it relates and only where legally effective.

32. Entire Agreement

These Terms, together with the policies incorporated into them by reference, form the agreement governing your access to and use of the Services.

They replace earlier versions of these Terms concerning the same subject matter.

Nothing in this section excludes statements, representations or information that legally form part of a consumer purchase contract.

33. Assignment

You may not transfer your customer account or contractual obligations to another person without our prior approval, except where applicable law permits the transfer.

We may transfer our rights and obligations in connection with a legitimate business sale, restructuring or transfer of business assets where legally permitted.

Any transfer by us will not reduce your mandatory consumer rights.

Where required by law, customers will be informed of a material transfer.

34. Governing Law and Disputes

These Terms and purchases made through our online store are governed by the laws of Denmark, subject to applicable mandatory consumer protection rules.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you and cannot legally be waived.

We encourage customers to contact us first if a dispute or complaint arises so that we can attempt to resolve the matter directly.

You may contact us at:

Email: massageskolen@live.dk
Telephone: +45 51 23 63 05

Postal address:
Uddannelse i Meditativ Healingmassage
C/O John Henrik Molich Rimestad
Hyrdevej 21, tv
8500 Grenaa
Denmark

Where a dispute cannot be resolved directly, you may have the right to refer the matter to an appropriate consumer dispute resolution body or a competent court.

Nothing in these Terms requires a consumer to waive a right to bring a claim before a court that has jurisdiction under applicable consumer law.

35. Amendments to These Terms

We may update these Terms when reasonably necessary to reflect:

  • Changes to the Services;

  • Changes in business practices;

  • Changes in technology;

  • Legal or regulatory requirements;

  • Security developments; or

  • Other legitimate operational reasons.

The latest version will be published through our online store together with its effective or revision date.

Where legally required, additional notice will be provided before a material change takes effect.

Changes to these Terms will not retroactively remove mandatory rights relating to an order or purchase agreement that has already been completed.
